In case you don't already know about this or want to know what you can
do about it... The bill, "The Phase-In Overtime for Agricultural Workers
Act of 2016" has been sponsored by the UFW. The bill was introduced on
February 19 in the state legislature, and it would gradually move toward
paying California’s farm workers overtime if they work more than eight
hours a day or 40 hours a week by the year 2020.

Coming on the heels of the $15 an hour minimum wage hike, another bill
that will greatly impact agriculture wage and hour laws has been set for
a hearing in the Assembly Appropriation Committee. The bill was heard on
April 6 in the Assembly Labor and Employment Committee, where it passed
on a party line vote with Democrats supporting the bill. Brad Goehring,
chair of the CAWG State Government Affairs Committee, and employees from
Kautz Vineyards spoke in opposition to the bill during the hearing.
AB 2757 by Assemblymember Lorena Gonzalez (D – San Diego) will eliminate
the longstanding 10 hours per day/60 hours per week overtime requirement
for agricultural workers and replace it with an 8 hour per day/40 hour
per week overtime system. Such a system is bad for employers and
employees, and ignores the seasonal nature of agricultural work.
California is one of only four states that require premium pay for
overtime worked by farm workers. Additionally, California farmers face a
number of other regulatory and legal burdens that do not encumber
farmers in other states and countries. AB 2757 represents yet another
obstacle that continues to tilt the economic playing field away from
California’s farmers, putting them at a competitive disadvantage, while
also adversely affecting farm workers.
If passed, AB 2757 will negatively impact workers, increase labor costs,
and make California agricultural products less competitive on a global
market.
